General Terms of Use

These Terms of Use govern access to and use of HyperApps, including its web interfaces, APIs, and related cloud services.
1. Definitions and scope
Client means any individual or legal entity using HyperApps. Service means all cloud features, APIs, and interfaces provided by HyperApps.
Any use of the Service implies full acceptance of these Terms of Use.
2. Account creation and access control
The Client is responsible for accurate account information and for managing access rights granted to its users.
The Client must protect credentials, enable recommended security controls, and promptly report any suspected unauthorized access.
3. Service model and best-efforts obligation
HyperApps is operated by a human-scale team and provides the Service on a best-efforts basis, with diligence, transparency, and incident prioritization.
HyperApps implements reasonable security and availability measures but does not guarantee uninterrupted availability or the absence of all defects.
4. Acceptable use
The Client agrees to use the Service in compliance with applicable law and security best practices.
- No unlawful, fraudulent, or harmful activity against third parties.
- No attempts to bypass security controls or intentionally disrupt the Service.
- No malicious code, malware, botnet activity, or intrusion attempts.
5. Customer data, backups, and continuity
The Client remains the owner of its data and is responsible for content uploaded to the platform.
The Client acknowledges that data loss, corruption, or temporary unavailability risks exist in any cloud environment.
HyperApps strongly encourages regular backups, restore testing, business continuity planning, and fit-for-purpose retention policies managed by the Client.
6. Confidentiality and protection
HyperApps implements reasonable technical and organizational measures to protect data confidentiality, integrity, and availability.
The Client remains responsible for sharing settings, internal role management, and data classification.
7. Maintenance and service evolution
HyperApps may perform preventive or corrective maintenance that can temporarily affect the Service.
HyperApps may evolve features for technical, security, legal, or product reasons while preserving a reasonable service level.
8. Support
Support is provided according to the subscribed plan. Response times are reasonable targets unless specific contractual SLA commitments apply.
The Client agrees to provide relevant diagnostic details (context, logs, reproduction steps) to help resolution.
9. Intellectual property
HyperApps retains all intellectual property rights over the platform, software components, documentation, and updates.
No transfer of rights is granted beyond a non-exclusive, non-transferable right to use the Service for the subscription duration.
10. Suspension and termination
HyperApps may suspend all or part of the Service in case of non-payment, unlawful use, security threat, or material breach of these Terms.
The Client may terminate under its subscription terms. Data export may be requested before closure, subject to technical feasibility.
11. Liability
To the extent permitted by law, HyperApps is not liable for indirect, consequential, or non-material damages (including loss of business, revenue, goodwill, or opportunity).
Unless mandatory law states otherwise, HyperApps total liability is capped at the net amount paid by the Client during the twelve months preceding the damage event.
These limitations do not apply where exclusion is prohibited by law (for example, wilful misconduct or gross negligence where applicable).
12. Governing law and jurisdiction
These Terms of Use are governed by French law.
Failing amicable resolution, disputes fall under the competent courts of HyperApps registered office jurisdiction, subject to mandatory legal rules.
